VirtuCam Disclaimer and Limitation of Liability

VirtuCam is a software application developed for legitimate purposes, such as enabling users to modify, enhance, or simulate camera feeds for personal, educational, testing, entertainment, or non-commercial creative activities, including but not limited to virtual backgrounds, video editing simulations, or software development testing. The application is designed to allow users to spoof or replace webcam data streams in a controlled manner, provided such use complies with all applicable laws and regulations. The developer has created VirtuCam with the intent to facilitate lawful innovation and user creativity, and any revenue generated from its distribution is derived solely from providing this tool for permissible applications.

No Warranty and "As Is" Provision: VirtuCam is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation. The developer expressly disclaims all such warranties to the fullest extent permitted by law.

Limitation of Liability: In no event shall the developer, its affiliates, officers, directors, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages (including but not limited to loss of profits, data, use, goodwill, or other intangible losses) arising out of or in connection with the use, misuse, or inability to use VirtuCam, even if advised of the possibility of such damages. This limitation applies regardless of the legal theory under which such damages are sought, whether in contract, tort (including negligence), strict liability, or otherwise. The developer's aggregate liability, if any, shall not exceed the amount paid by the user for VirtuCam, if applicable.

User Responsibility and Lawful Use Requirement: Users are solely responsible for ensuring that their use of VirtuCam complies with all applicable local, state, federal, and international laws, regulations, and third-party terms of service, including but not limited to those governing data privacy (e.g., GDPR, CCPA), intellectual property, fraud prevention, identity verification, and anti-deception statutes. VirtuCam must not be used for any illegal, fraudulent, deceptive, or harmful activities, such as bypassing Know Your Customer (KYC) processes for unlawful purposes, committing identity theft, perpetrating scams, infringing on copyrights or trademarks, harassing others, or any other conduct that violates criminal or civil laws. The developer does not endorse, facilitate, or assume any responsibility for such misuse. Any illegal use by a user is at their own risk and peril, and the developer shall not be held accountable or liable for any consequences, including but not limited to civil penalties, criminal prosecution, or third-party claims arising therefrom.

Indemnification: By using VirtuCam, users agree to indemnify, defend, and hold harmless the developer and its affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) the user's violation of these terms; (ii) the user's misuse of VirtuCam; or (iii) any content created, modified, or transmitted using the application.

Severability and Governing Law: If any provision of this disclaimer is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This disclaimer shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of laws principles. Any disputes arising hereunder shall be resolved exclusively through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association, and users hereby waive any right to a jury trial or class action participation.

By downloading, installing, or using VirtuCam, users acknowledge that they have read, understood, and agree to be bound by this disclaimer in its entirety. If users do not agree, they must immediately cease all use of the application. The developer reserves the right to modify this disclaimer at any time, with continued use constituting acceptance of any changes.
